Terms of Service

These Terms explain the rules for using this AI image generation and upscaling service.

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Does

The Service can create images from text prompts. It can also use a reference image or upscale, improve, and modify an image you upload.

The Service uses xAI to create and upscale images. xAI may process your prompt, any image you provide, and related request information so the Service can return your result.

If you choose Enhance Prompt, OpenRouter sends your text prompt to a provider serving DeepSeek V4 Flash and returns the improved prompt.

We do not sell API access. We provide image generation and upscaling tools for end users.

2. Who Can Use the Service

You must be at least 18 years old to use the Service.

You may not use the Service if you are legally barred from using it, or if using it would violate the laws where you live.

3. Your Images and Prompts

You are responsible for anything you upload, submit, or create using the Service.

By using the Service, you confirm that:

You own the images you upload, or you have permission to use them.
You have any consent needed from people shown in the images.
Your uploads do not violate someone else's copyright, trademark, privacy, publicity, or other rights.
Your use of the Service is legal.

Do not upload images that you do not have the right to use.

4. What You May Not Do

You may not use the Service to create, edit, enhance, or distribute content that is illegal, harmful, abusive, deceptive, or violates someone else's rights.

You may not use the Service to:

Create sexual images of real people without their consent.
Create, edit, or enhance sexual content involving minors.
Harass, threaten, abuse, or exploit anyone.
Impersonate someone in a misleading way.
Create fake or misleading images meant to trick people.
Violate someone's privacy or right of publicity.
Upload stolen, hacked, or illegally obtained images.
Violate copyright, trademark, or other intellectual property rights.
Create content for fraud, scams, phishing, or other illegal activity.
Bypass safety systems, usage limits, or access controls.
Reverse engineer, scrape, copy, or misuse the Service.
Resell access to the underlying AI models or APIs.
Use the Service to build or run a competing AI model access service.
Use outputs from the Service to train, fine tune, or improve another AI model.

We may block, remove, or refuse content that appears to violate these rules.

5. Images Generated or Modified by AI

Images created or modified by AI can be inaccurate, unrealistic, distorted, or misleading.

You are responsible for reviewing the final image before using, posting, selling, or sharing it.

Do not present images modified by AI as real, original, or unedited if that would mislead people. When needed, clearly disclose that AI was used.

6. Rights to Your Content

You keep whatever rights you already have in the images you upload.

You give us permission to process your uploaded images and prompts only as needed to provide, secure, improve, and operate the Service.

This includes sending your content to outside AI providers, hosting providers, moderation tools, payment processors, and other vendors needed to run the Service.

You are responsible for making sure you have the legal right to give us this permission.

7. Outside AI Providers

The Service may depend on outside AI providers. Their rules may apply to your use of the Service.

These providers may change their models, pricing, limits, safety rules, availability, or terms at any time.

We are not responsible for outages, delays, errors, rejected requests, changed model behavior, or unavailable models caused by an outside provider.

8. Privacy

We collect and process information needed to provide the Service. This may include uploaded images, prompts, generated outputs, account information, payment information, device information, logs, and usage data.

Uploaded images and generated outputs may be processed by outside providers.

Do not upload private, sensitive, or confidential images unless you understand and accept that they may be processed by outside systems.

We may keep records as needed for security, abuse prevention, customer support, billing, legal compliance, and service operation.

9. Payments and Credits

Some features may require payment, credits, or a subscription.

Each successful prompt enhancement uses one cent of credit. If prompt enhancement fails, that credit is returned.

Prices, credit usage, limits, and available features may change.

Unless we clearly say otherwise, payments cannot be refunded once the Service has started processing your request or credits have been used.

We may refuse refunds for abuse, policy violations, or misuse of the Service.

10. Service Availability

We try to keep the Service working, but we do not guarantee that it will always be available, fast, free of errors, or uninterrupted.

The Service may fail, slow down, reject a request, produce poor results, or become unavailable.

We may change, limit, suspend, or stop any part of the Service at any time.

11. No Guarantees

The Service is provided "as is."

We do not guarantee that:

An image will be improved.
The result will meet your expectations.
The output will be accurate, realistic, or usable.
The Service will work for every image.
The Service will be available at all times.
The output will be legally safe for your specific use.

You are responsible for deciding whether an output is suitable for your use.

12. Your Responsibility

You agree that you are responsible for:

The images you upload.
The prompts you submit.
The outputs you create.
How you use or share those outputs.
Any harm caused by your misuse of the Service.
Any legal claims caused by your content or your use of the Service.

If your use of the Service causes a legal claim, dispute, loss, or cost, you agree to hold us harmless to the fullest extent allowed by law.

13. Account Suspension or Termination

We may suspend or terminate your access if:

You violate these Terms.
You misuse the Service.
Your use creates legal, security, or abuse risk.
An outside provider requires us to do so.
We believe your activity may harm the Service, other users, or third parties.

We may also remove content or refuse processing requests.

14. Limitation of Liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.

This includes lost profits, lost data, lost business, reputational harm, or claims related to AI outputs.

To the fullest extent allowed by law, our total liability for any claim is limited to the amount you paid us for the Service during the 30 days before the claim.

15. Changes to These Terms

We may update these Terms from time to time.

If the changes are important, we may provide notice through the Service, by email, or by posting the updated Terms.

Your continued use of the Service after the Terms are updated means you accept the updated Terms.
